When houses sell for MORE money, as compared to de-valued or degraded prices, the new owners pay higher property taxes, which benefits the budgets of all school districts. This is why many cities have View-Protection Ordinances...but not Carlsbad.
Carlsbad City Hall is at the base of Mount Kelly. There are many hills and hillside homes in Carlsbad. There are plenty of envious and jealous people in America today, most of whom are Democrats, constantly complaining about "Rich people don't pay enough taxes." Envious people plant trees, rarely smaller fruit trees, just to bother the "hated and undeserving Rich people" who live higher on the hill. Carlsbad Police Dept has a list of addresses where things have are heated and hostile between neighbors over view obstructions and view eliminations.
Up Mount Kelly from city hall, there are communities named Sea View Estates and Ocean View Estates. These names appear in the Legal Descriptions of all the properties contained therein. There used to be an ordinance within Carlsbad's Landscape Manual that read, "Street Trees are prohibited within five feet of paving." This is obviously a good ordinance, because who would plant trees with fifteen-foot branches within five feet of a road?!?! Well, actually, with tax dollars, Carlsbad city hall has planted hundreds, if not thousands, of trees ON PRIVATE PROPERTY (via "right of way" excuse)....just two feet from many streets...especially in the hills, to include Oceanview Estates. This violation of City Hall's ordinance has created many encounters/contacts between vehicles and tree branches.
Sometimes the branches fall to the road, and sometimes the branches just dangle in the air. We know of a Carlsbad citizen, a military man, who took the time to remove the displaced branches; branches that shouldn't have been there to begin with, owing to city hall's ordinance. The man removed NO TREES, just badly located, badly damaged branches. Carlsbad city hall responded by deleting their ordinance, AND filed a civil lawsuit against the decent citizen. Though they were seeking $80,000 in damages, the judge awarded America's worst city hall JUST ONE DOLLAR from the Defendant, who had no lawyer. Everybody knows that when a judge gives a one-dollar judgement to any Suer, or is that "Sewer," the intended hand signal from the judge is just one finger held in the air.....and we know which finger that is!
